These Terms of Use (“Terms”) govern your access to and use of the Plan Roam mobile application (“the App”, “Licensed Application”). By creating an account or using the App, you agree to these Terms.

Plan Roam is a social media-based real-time AI-powered travel planning application. Users can create travel plans and invite friends, other users can request to join plans. Plan creators can grant admin privileges to participants to collaboratively add, edit, and reorder locations on routes in real-time. Plan Roam allows users to create plans from start to finish with a single AI prompt, add locations to their plans, or optimize their plans using AI credits.

1. Licensed Application End User License Agreement

1.1 Acknowledgment

Apps made available through the App Store are licensed, not sold, to you. Your license to the Plan Roam App is subject to your prior acceptance of this Terms of Use agreement, which incorporates the Apple Licensed Application End User License Agreement (“Standard EULA”) available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.

1.2 Scope of License

Plan Roam (“Licensor”) grants to you a nontransferable license to use the Licensed Application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. The terms of this agreement will govern any content, materials, or services accessible from or purchased within the Licensed Application as well as upgrades provided by Licensor that replace or supplement the original Licensed Application.

1.3 License Restrictions

Except as provided in the Usage Rules, you may not:

Distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time
Transfer, redistribute, or sublicense the Licensed Application
Copy (except as permitted by this license and the Usage Rules), reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application, any updates, or any part thereof (except as and only to the extent that any foregoing restriction is prohibited by applicable law)

If you sell your Apple Device to a third party, you must remove the Licensed Application from the Apple Device before doing so.

You agree that Licensor may collect and use technical data and related information—including but not limited to technical information about your device, system and application software, and peripherals—that is gathered periodically to facilitate the provision of software updates, product support, and other services to you related to the Licensed Application. Licensor may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide services or technologies to you.

1.5 Termination

This agreement is effective until terminated by you or Licensor. Your rights under this agreement will terminate automatically if you fail to comply with any of its terms.

2. Eligibility

You must be at least 13 years old to use Plan Roam.

3. User Responsibilities

By using the App, you agree:

To provide accurate information
To use the App for lawful purposes only
Not to upload harmful, abusive, or inappropriate content
Not to harass or spam other users
Not to attempt unauthorized access or interfere with the App’s functionality
Not to use the External Services in any manner that is inconsistent with these Terms or that infringes the intellectual property rights of Plan Roam or any third party
Not to use the External Services to harass, abuse, stalk, threaten, or defame any person or entity

4. User-Generated Content

You are responsible for the content you create and share, including:

Travel Plans
Routes and Locations
Photos
Comments
Collaborative Plan Content

You grant Plan Roam a license to display your content solely for the operation of the App.

You retain full ownership of your content.

Plan Roam allows you to create travel plans and share them with other users. As a plan creator, you have the ability to:

Invite friends to join your plans
Accept or reject join requests from other users
Grant or revoke admin privileges to participants
Remove participants from your plans

5.2 Real-Time Collaboration

Participants with appropriate permissions can collaboratively edit plans in real-time, including:

Adding, editing, and removing locations
Reordering route stops
Modifying plan details

5.3 User Interactions

You are solely responsible for your interactions with other users. Plan Roam is not responsible for the conduct of any user, whether online or offline.

6. Subscriptions and In-App Purchases

6.1 Subscription Services

Plan Roam offers subscription-based services that provide access to premium features. Subscription details, including pricing and features, are displayed within the App prior to purchase.

6.2 AI Credits

Plan Roam uses an AI credit system for artificial intelligence-powered features:

AI credits are consumed when using AI-powered plan generation, location suggestions, and plan optimization features
AI credits may be included with subscription plans or purchased separately as in-app purchases
AI credits are non-refundable and non-transferable
Unused AI credits do not expire unless your account is terminated

6.3 Payment and Billing

Payment will be charged to your iTunes Account at confirmation of purchase. Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan. Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user’s Account Settings on the device. Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable.

You can manage and cancel your subscriptions by going to your App Store account settings after purchase

6.4 Refunds

All purchases are subject to the App Store’s refund policy. Refund requests must be made through Apple. Plan Roam does not have the ability to process refunds directly.

6.5 Price Changes

Plan Roam reserves the right to change subscription prices. Any price changes will take effect at the start of the next subscription period following the date of the price change. Your continued use of the subscription after the price change becomes effective constitutes your agreement to pay the new price.

7. Artificial Intelligence Services

7.1 AI-Powered Features

Plan Roam offers AI-powered features including:

Single-prompt complete travel plan generation
AI-assisted location recommendations
Route optimization
Personalized travel suggestions

7.2 AI Limitations

AI-generated content is provided for informational purposes only
We do not guarantee the accuracy, completeness, or suitability of AI-generated recommendations
You should independently verify all AI-generated travel information, including opening hours, prices, and availability
AI features require an internet connection and may not be available in all regions

7.3 AI Usage Policy

AI features must be used in accordance with these Terms
You may not use AI features to generate illegal, harmful, or inappropriate content
Plan Roam reserves the right to limit or suspend AI feature access for users who abuse the system

8. External Services

The Licensed Application may enable access to Plan Roam’s and/or third-party services and websites (collectively and individually, “External Services”). You agree to use the External Services at your sole risk. Plan Roam is not responsible for examining or evaluating the content or accuracy of any third-party External Services, and shall not be liable for any such third-party External Services.

Data displayed by the Licensed Application or External Service, including but not limited to location information, travel recommendations, and route data, is for general informational purposes only and is not guaranteed by Plan Roam or its agents.

External Services may not be available in all languages or in your Home Country, and may not be appropriate or available for use in any particular location. To the extent you choose to use such External Services, you are solely responsible for compliance with any applicable laws.

Plan Roam reserves the right to change, suspend, remove, disable, or impose access restrictions or limits on any External Services at any time without notice or liability to you.

9. Account Termination

We may suspend or terminate accounts that:

Violate these Terms
Engage in harmful behavior
Abuse the platform or other users
Misuse AI features or credits
Engage in fraudulent activity

You may delete your account at any time through the App settings or by contacting support.

10. Disclaimer and No Warranty

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE LICENSED APPLICATION IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED APPLICATION AND ANY SERVICES PERFORMED OR PROVIDED BY THE LICENSED APPLICATION ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND PLAN ROAM HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE LICENSED APPLICATION AND ANY SERVICES, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NONINFRINGEMENT OF THIRD-PARTY RIGHTS.

NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY PLAN ROAM OR ITS AUTHORIZED REPRESENTATIVE SHALL CREATE A WARRANTY. SHOULD THE LICENSED APPLICATION OR SERVICES PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION.

Plan Roam does not guarantee:

Uninterrupted or error-free service
Accuracy of AI-generated recommendations
Availability of third-party services or locations
User behavior or content

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO THE ABOVE EXCLUSION AND LIMITATIONS MAY NOT APPLY TO YOU.

11. Limitation of Liability

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL PLAN ROAM BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE LICENSED APPLICATION, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF PLAN ROAM HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR PERSONAL INJURY, OR OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION MAY NOT APPLY TO YOU.

In no event shall Plan Roam’s total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of fifty dollars ($50.00). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

12. Export Compliance

You may not use or otherwise export or re-export the Licensed Application except as authorized by United States law and the laws of the jurisdiction in which the Licensed Application was obtained. In particular, but without limitation, the Licensed Application may not be exported or re-exported (a) into any U.S.-embargoed countries or (b) to anyone on the U.S. Treasury Department’s Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List or Entity List.

By using the Licensed Application, you represent and warrant that you are not located in any such country or on any such list. You also agree that you will not use these products for any purposes prohibited by United States law.

13. Commercial Items

The Licensed Application and related documentation are “Commercial Items”, as that term is defined at 48 C.F.R. §2.101, consisting of “Commercial Computer Software” and “Commercial Computer Software Documentation”, as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable.

14. Changes to the App

We may modify, update, or remove features at any time. This includes changes to AI features, credit systems, and subscription offerings.

15. Intellectual Property

All branding, logos, design elements, and proprietary technology (including AI models and algorithms) belong to Plan Roam and may not be copied or reused without permission.

16. Governing Law

These Terms and the relationship between you and Plan Roam shall be governed by the laws of the applicable jurisdiction. If you are a citizen of any European Union country, Switzerland, Norway, or Iceland, the governing law and forum shall be the laws and courts of your usual place of residence.

For users in the United States, these Terms shall be governed by the laws of the State of California, excluding its conflicts of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Santa Clara, California, to resolve any dispute or claim arising from these Terms.

Specifically excluded from application to these Terms is that law known as the United Nations Convention on the International Sale of Goods.
